Terms of Service

1. Who we are

Palette is a colour-bar management app for hair salons, operated by Palette Scale Pty Ltd, ABN 12 701 601 505 (“Palette”, “we”, “us”). These terms cover your use of the Palette app and website. By using Palette, or by signing up for the pilot or a paid plan, you agree to them.

2. What Palette does

Palette lets a salon record colour formulas, weigh products live during a service, track product cost and inventory, and generate reorder and usage reports. It is a tool for the salon team. It is not a point-of-sale, a booking system, or a payment processor; those stay with your existing providers.

3. Pilot and paid plans

The pilot is free. During the pilot you use Palette at no cost, and you are never charged automatically. If you choose to continue on a paid plan afterwards, we agree the pricing with you in writing before any charge is made.

Paid plans are month-to-month. There is no fixed-term contract and no lock-in. Fees are as agreed with you or as shown on our pricing page, in Australian dollars, plus GST where it applies.

4. Cancelling

You can cancel a paid plan at any time, effective at the end of your current month. When your account closes we follow the export and deletion workflow in our privacy policy: we can send you a full export of your data, then archive and delete it, except where we are legally required to keep records.

5. The scale

Where we provide an Acaia scale on loan for the pilot, it stays ours during the pilot and you agree to take reasonable care of it. If you continue on a paid plan the scale is yours to keep at no extra charge. If you do not continue, you return it to us in good working order, fair wear and tear excepted, within the time we agree.

6. Your data

You own your salon’s data: your formulas, clients, products, and usage. We store it securely in Australia and use it only to run Palette for you and to support you. How we handle personal information is set out in our privacy policy. We own the Palette software, brand, and everything we build; nothing in these terms transfers that to you.

7. Acceptable use

Use Palette lawfully and for running your salon. Don’t try to break, overload, reverse-engineer, or gain unauthorised access to it, and don’t upload anything unlawful or that isn’t yours to upload. You are responsible for keeping your stylist PINs and manager sign-in secure.

8. Third-party services and names

Palette works alongside third-party tools such as your booking or point-of-sale platform, accounting software, and the Acaia scale. Those tools are run by their own providers on their own terms, and what they let Palette do can change; we are not responsible for their availability or their conduct.

All third-party product and company names are trademarks of their respective owners. Naming them describes compatibility only. Palette is not affiliated with, sponsored by, or endorsed by any of them.

9. Availability

We work hard to keep Palette running, but during the pilot it is early software: we don’t offer an uptime guarantee or a service-level agreement, and you should keep your existing records in parallel until you’re confident. We may change, add, or remove features as the product develops.

10. Consumer guarantees and warranties

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any right or remedy you have under that law. Subject to those rights, and to the extent the law allows, Palette is provided on an “as is” and “as available” basis.

11. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, revenue, or data. Where our liability cannot be excluded but can be limited, it is limited to resupplying the service or paying the cost of having it resupplied. Nothing here limits liability that the law says cannot be limited, including under the Australian Consumer Law.

12. Changes to these terms

We may update these terms as Palette changes. If we make a material change we will update this page and the effective date, and for account holders we will give reasonable notice through the app or by email before it takes effect.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts there have jurisdiction.
